Ministry of Public Security released a draft of the public security administration regulations of the lodging industry for public consideration. It is stipulated that lodging properties are prohibited to spread, sell and leak the guest information or videos and monitor materials. Otherwise, those residential business properties shall be given criminal sanctions.
The rule defines lodging properties as hourly or daily charged business places, with necessities and facilities, in which attendants offer lodging services for the public, including hotels, hostels, inns, training center, resorts, apartment hotels, agritainment lodge, homestays and those places where bathing, pedicure or massage is served.
According to the 25th rule, the lodging places and their staff are not allowed to spread, sell, provide, leak, delete and revise the accommodation information of guests or videos and monitor materials, except that the national departments concerned carry out investigation according to law and guests have consented. If the providers should make a record if they offer the guest information to the relevant authorities, units and individuals.
The rule also states the legal liability borne for the leak of the guest information: by violation of the following 25th rule, punishment shall be given according to the rules of China Public Order Management and Punishment Law; the case constitutes a crime, criminal responsibilities shall be affixed; If there are property losses, it shall assume compensation liability.
